DECIDING DEATH

** FILE ** Convicted killer Gary Mark Gilmore arrives heavily guarded at 4th District Court in Provo, Utah, Dec. 1, 1976, to get a new date of execution by firing squad. The first person executed after the Supreme Court reinstated the death penalty in 1976, did little to help his case during the half-day penalty phase of his two-day trial. Gilmore had been expected to express remorse when he was asked if he had anything to say. He said: "I am finally glad to see that the jury is looking at me." (AP Photo/Ron Barker/File)
